While sports betting initially launched in Florida in late 2021, it was only available in the state for 35 days before it was “temporarily suspended” due to litigation challenging the state’s gaming compact.
That period of suspension lasted nearly two years before the state relaunched sports betting. Online sports betting opened in Florida in November 2023, followed by retail sports betting the following month.
Due to its limited sports betting options, Florida residents and visitors don’t have access to some of our favorite sportsbooks.
Is DraftKings Legal in Florida?
No, DraftKings Sportsbook isn’t legal in Florida. While sports betting is legal in Florida, it’s only available online via the Hard Rock Bet app or in person at any of the state’s six Hard Rock Sportsbook locations.
Florida’s lack of sports betting options can be traced back to Amendment 3, which prohibited the Florida Legislature from passing gambling expansions without the approval of the Seminole Tribe. The amendment led to two different casinos filing lawsuits against the Department of the Interior along with an anti-gambling group.
That blowback resulted in the state suspending sports betting for nearly two years before allowing Hard Rock Bet to relaunch on Nov. 7, 2023. In-person sports betting relaunched a month later on Dec. 7.
Hard Rock Bet will likely be Florida’s only online sportsbook for a while, as the Seminole Tribe and the state of Florida are locked in multiple court cases that likely won’t end until 2025 at the earliest. Other online sportsbooks won’t be allowed to operate in the Sunshine State until those court cases are settled.
That said, DraftKings’ daily fantasy sports app is available in Florida, as daily fantasy sports aren’t subject to the same regulations as sportsbooks. If you’re 18+ and physically present in Florida, you can download and use DraftKings’ DFS app.
DraftKings Florida Promotion

Sportsbooks also have offers for existing customers like odds boosts and referral bonuses, but they are not as generous as the welcome offers for first-time users.
